§ 16-27. Enforcement.
(a)
This article may be enforced by the emergency management officer, any peace officer acting within the officer's area of jurisdiction, a firefighter or other officer of a fire district acting within the officer's area of jurisdiction, or a county parks division official acting within the official's area of jurisdiction.
(b)
Firefighters or other officers of a fire district will investigate reports of fires or fireworks usage within unincorporated areas of the fire district and the wildfire response area of the fire district as designated by state forestry and make first contact with the responsible parties.
(c)
Enforcement will consist of informing the parties responsible for violations of the article that restrictions or prohibitions are in force under the article and request the parties to extinguish open fires or cease use of fireworks that are violations of the article. If the responsible parties do not voluntarily comply with the request, they will be ordered to comply and informed that failure to comply will result in citation by law enforcement officers.
(d)
If the responsible parties still fail to comply with the request, law enforcement officers (if not already present) will be summoned to enforce the provisions of the article through citation. The county sheriff's deputies will respond to fire district requests to enforce provisions of the article within the limitations of deputy availability.
