§ 16-23. Determination of fire emergency.
(a)
The emergency management officer shall be responsible for determining when a fire emergency exists within one or more fire-ban zones.
(b)
A fire emergency determination shall be based upon such factors as may be deemed relevant by the emergency management officer, including, but not limited to, or bound by conformance with, the imposition of fire restrictions within the boundaries of the county by federal, state or local agencies having the authority to impose such restrictions. The emergency management officer will consult with chiefs of fire districts within or adjacent to a fire-ban zone, as well as representatives from the state forestry and the Bureau of Land Management, to obtain information to help determine whether a fire emergency exists within that zone.
(c)
Upon a determination that a fire emergency exists, the emergency management officer shall issue a written notice of fire emergency determination and shall provide a copy of said notice to the board, specifying the basis on which the determination was made and request that the board enact an outdoor fire and permissible consumer fireworks prohibition in one or more fire-ban zones.
