§ 16-24. Enactment of prohibition.

  • (a)

    If, following receipt of a fire emergency determination and request for an outdoor fire and permissible consumer fireworks prohibition, the board, by majority vote, determines that prohibitions on open fires, campfires, and permissible consumer fireworks are necessary to protect public health and safety, the board may issue an order enacting an outdoor fire and permissible consumer fireworks prohibition.

    (b)

    The order shall specify the effective date of the prohibition and the fire-ban zone(s) within which the prohibition shall be effective.

    (c)

    If the emergency management officer requests immediate imposition of restrictions pursuant to section 16-25, the chairman of the board may issue an interim order imposing the restrictions, subject to ratification by majority vote of the board at its next regularly scheduled meeting.

    (d)

    Irrespective of any action by the board to issue an order enacting an outdoor fire and permissible consumer fireworks prohibition, the parks division of the county public works shall have the authority to impose and enforce restrictions or prohibitions within the boundaries of any county park, including temporary day-to-day restrictions or prohibitions due to weather conditions, if it is determined by the parks division and/or the emergency management officer that such restrictions or prohibitions are necessary to protect the public safety and county property.
