MOHAVE COUNTY ORDINANCE NO. 2015-07 AN ORDINANCE AMENDING THE MOHAVE COUNTY ZONING ORDINANCE AS RECOMMENDED BY THE PLANNING AND ZONING COMMISSION PURSUANT TO ARIZONA STATE STATUTES. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November 2, 2015, a public hearing was conducted to determine whether approval should be granted to amend the Mohave County Zoning Ordinance, and WHEREAS, beginning in July 2013, a subcommittee of the Planning and Zoning Commission, the Zoning Ordinance Review Subcommittee, began an effort to amend the Mohave County Zoning Ordinance and bring the aged document current with the realities of modern living and modern development, and reduce regulatory requirements and restrictions on citizens, developers and businesses, and WHEREAS, proposals for the revised Ordinance include, but are not limited to, the following: • Reduction in many of the development setback requirements, reflecting current design trends, • Increasing residential lot coverage for residential lots, • Providing for simplified and streamlined procedures for some administrative land use permits that would be issued by the Department, • Allowing some accessory residence permits to be issued administratively, • Allowing cottage industries in some Agricultural-Residential zone properties, • Modernization of the sign portion of the Ordinance, • Removal of the instructions Mohave County Policies for Addressing and Road Naming as the policies did not belong in the Ordinance. • Removal of sections that are not pertinent or enforceable, and WHEREAS, all of the Subcommittee meetings were advertised in a newspaper published in the county seat notifying the public of the Subcommittee meetings. Meetings of the Subcommittee continued until April, 2015. Members of the public regularly attended. Their attendance influenced many sections of the amended Ordinance including cottage industries and signage. The proposed amendments have been posted on the Mohave County website for 60 days. A press release was posted on the County's website notifying the public of the availability of the draft and giving instructions on commenting. One comment was received requesting that recreational vehicles be allowed as temporary dwellings in the A (General) zone, and WHEREAS, at their meeting on April 8, 2015, the Subcommittee agreed that the amended Ordinance was ready to be presented to the Planning and Zoning Commission. That presentation occurred on June 10, 2015, and WHEREAS, A.R.S. § 11-813 requires the Commission to formulate and draft a zoning ordinance, and recommend the ordinance to the Board of Supervisors. Before recommending the ordinance to the Board, the Commission must hold at least one public hearing, after giving at least fifteen days' notice in a newspaper of general circulation in the county seat, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on September 9, 2015, the Commission recommended APPROVAL of this Ordinance which is to include the section on Industrial Performance Standards. WHEREAS, A.R.S. § 11-813 requires the Board to consider the Commission's recommendation and hold at least one public hearing at which residents of the County shall be heard, and WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on October 18, 2015 and was posted on October 16, 2015, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, November 2, 2015, APPROVED this Ordinance, including Exhibit A, as recommended by the Mohave County Planning and Zoning Commission and outlined herein. |
