§ 34-214. Definitions.

The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

Agricultural and mining exemption. The exemption shall be in accordance with A.R.S. § 11-812 and shall apply if the tract concerned is five or more contiguous commercial acres.

Agricultural use of land and farming means the tilling of the soil, raising of crops, horticulture, vineyards, forestry, small livestock farming, dairying, and/or pasture and range livestock production, including all uses customarily incidental thereto, but not including concentrated animal feeding operations, slaughterhouses, fertilizer yards, plants for the reduction of animal matter, or any other use that is allowed only in a manufacturing zone.

Business or commerce means the purchase, sale, or other transaction involving the handling or disposition (other than included in the term "industry" as defined herein) of any article, substance or commodity for profit or livelihood, and including, in addition, office buildings, offices, shops for the use of personal services, garages, outdoor advertising signs and outdoor advertising structures, and recreational and amusement enterprises conducted for profit, but not including junk yards.

Colorado River water entitlement means a water entitlement for the legal right to access a specified amount of Colorado River water in a given time period, including subsurface water in the zone of influence of the Colorado River.

Industry means the manufacture, fabrication, processing reduction or destruction of any article, substance or commodity, or any other treatment thereof in such a manner as to change the form, character, or appearance thereof. The term "industry" shall include storage yards, warehouses, wholesale storage, and other similar types of enterprises.

Irrigation means the beneficial use of water or reclaimed water, or both, for growing crops, turf, or silviculture, or for landscaping.

Manufacturing means the fabrication of finished or more completely worked products from one or more raw materials, or semi-finished products, or the reprocessing of goods or materials, and may include storage, packing, and shipping.

Mining means the extraction of mineral or organic deposits from the earth, including permanent sand or gravel operations, either by means of open pits, shafts, or pipeline, except that the extraction of water does not constitute mining, nor is the operation of a temporary borrow pit or land leveling classified as mining.

Reclaimed water means water that has been treated or processed by a wastewater treatment plant or an on-site wastewater treatment facility per A.R.S. § 49-201(32) and A.A.C. R18-11-303 with revisions to date or any subsequent definition of A+ reclaimed wastewater replacing cited rule.

Subdivision means improved or unimproved land or lands divided or proposed to be divided for the purpose of sale or lease, whether immediate or future, into six or more lots, parcels or fractional interests.

Swimming pool means an artificial basin, chamber, or tank that is designed for swimming or diving.

Turf facilities means any park, sod farm, golf course, public lawn, event center, sports range, sports field, or any open area with a size of three or more aggregate acres planted with any of the following utilized as ground cover:

Plants of the family Graminoid.

(2)

Plants of the family Poaceae.

(3)

Plants of the genus Oxalis

(4)

Plants of the genus Trifolium.

(5)

Plants of the genus Dichondra.

(6)

Any cultivated landscape plant either native or non-native to the region utilized as groundcover requiring irrigation on one or more days per year.

Water feature means features including, but not limited to, manmade lakes, decorative pools, ponds, fountains, streams and waterfalls, unless a part of a publicly oriented outdoor or indoor recreation facility (e.g., swimming pool, splash pad or spa).
