  • (a)

Upon the adoption of these regulations by the board of supervisors, every owner or subdivider of any lot, tract or parcel of land situated within the unincorporated area of the county who seeks to subdivide land into two or more parts for the purpose of laying out or creating any subdivision, or minor land division, or any additions thereto, shall comply with the provisions of these regulations, unless otherwise exempted pursuant to this section.

    (b)

The following activities do not require subdivision or minor land division approval or review by the county. However, the county is not obligated to provide public access, nor issue a building permit to any lot, parcel or tract created outside of the subdivision process defined by these regulations when the lot, parcel or tract does not comply with minimum zoning requirements or creates a subdivision by acting in concert.

    (5)

Lot line adjustments do not require county review when such adjustment will not alter the current zoning for the parcel, nor create a lot that is not in compliance with the county zoning ordinance.

    (6)

Divisions of land that create parcels or lots 36 acres or larger.

    (7)

Subdivision into or development of parcels, plots or fractional portions within the boundaries of a cemetery that has been formed and approved pursuant to A.R.S. § 32-2101.
