§ 2-19. Withholding from or giving false information to the board of supervisors.

  • (a)

    Definitions. The following words, terms and phrases, when used in this section, shall have the meanings ascribed to them in this subsection, except where the context clearly indicates a different meaning:

    Board of supervisors means those persons elected to the board of supervisors, or his lawful successor, sitting at a lawfully noticed meeting.

    County employee means the county administrator, department directors, deputies and any and all other persons employed by the county, whether in unclassified or classified service. For purposes of this section, employee does not mean an elected official.

    Department means any county agency, department, office, institution, board, commission, committee and all other branches and divisions of county government.

    (b)

    A county employee or department shall not provide false information to any member of the board of supervisors knowing, or having reason to know, that the information is false, or withhold information to any member of the board of supervisors, with the intent to prejudice or influence a decision by the board of supervisors.

    (c)

    A county employee who violates this section is guilty of a Class 1 misdemeanor.

    (d)

    Any county employee who is convicted of violating any provision of this section, or is found to have violated this section following notice and opportunity to be heard in accordance with the administrative procedures of the county is subject to immediate termination of any county employment.
