§ 26-19. Intent and purpose.
(a)
Unpaved public roads, highways, and rights-of-way within the county are currently being sprayed or treated with various types of petroleum products.
(b)
Such products contain certain hazardous substances, toxic chemicals, metals, and other material which may have harmful effects on the public health and welfare of the citizens of the county.
(c)
The unregulated dispensing of these products may subject the groundwater and general environment to contamination through dispersion, filtration or percolation of these products and could also result in an increased deterioration of county public roadways.
(d)
Pursuant to the authorization granted by A.R.S. §§ 11-251(17) and 11-251.05(A)(1) for the purpose of regulating and abating the unauthorized spraying or dispensing of petroleum products on unpaved public roads, highways, or rights-of-way within the county.
