§ 18-84. Floodways.

  • Located within special flood hazard areas established in section 18-27 are areas designated as floodways. Floodways may not always be designated within each special flood hazard area. The owner and/or developer are responsible to obtain engineering for such flood hazard(s). Since the floodway is an extremely hazardous area due to the velocity of floodwaters, which carry debris, potential projectiles, and erosion potential, the following provisions apply:

    (1)

    Prohibit any encroachment, including fill, new construction, substantial improvements, and other development, unless certification by a state licensed, registered professional engineer is provided demonstrating that encroachments shall not result in any increase in flood levels during the occurrence of the base flood discharge, and written permission is provided by the district and any other necessary organization, by way of example and not limited to the U.S. Bureau of Reclamation, within the Colorado River floodway.

    (2)

    If this section is satisfied, all new construction, subsequent improvements, and substantial improvements shall comply with all other applicable flood hazard reduction provisions of this division.
