§ 10-19. Definitions.
The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
Food service establishment.
(1)
The term "food service establishment" means an operation that stores, prepares, packages, serves, vends, caters or otherwise provides food for human consumption. The term "food service establishment" includes any such place regardless of whether consumption is on or off the premises and regardless whether there is a charge for the food.
(2)
The term "food service establishment" also includes:
a.
Delicatessen operations that prepare sandwiches intended for individual service.
b.
Operations that are conducted in a mobile food unit.
c.
Meat/poultry cutting and packaging operations.
d.
Bakery operations.
(3)
The term "food service establishment" does not include:
a.
An establishment that offers only prepackaged foods.
b.
A produce stand that only offers whole, uncut fresh fruit and vegetables.
c.
A kitchen in a private home that prepares non-"potentially hazardous food," as defined in the Arizona Food Code 201.10(B)(61), for sale or service at a religious or charitable organization's bake sale.
